Article 2 - Scope of the Terms and Conditions and basic definitions

These Terms and Conditions govern the booking and temporary rental of e-bikes and accessories through the website, by e-mail, by telephone or in person. They form part of the contract concluded with the consumer. The Renter is the person who concludes the contract and is responsible for its performance. A Rider is a person named in the rental agreement as authorised to use the bicycle.
At personal collection, a rental agreement and a handover and return report are signed. Before signing, the Renter is given an opportunity to review the current Terms and Conditions, the operating rules and the price list of typical damage

Article 3 - Subject matter and main characteristics of the service

The service consists of temporarily providing the selected e-bike and ordered accessories for recreational use during the confirmed rental period. The particular model, serial number, accessories, handover time and bicycle condition are recorded in the handover report. Website photographs are illustrative; the material characteristics of the booked bicycle and the price are shown before the booking is submitted.

Article 4 - Booking and conclusion of the contract

• A booking may be submitted by a person aged 18 or over. A minor may be a Rider only with the consent and under the responsibility of a legal guardian or an adult Renter and must be named in the rental agreement
• Before submission, the selected bicycle, rental period, scope of service, final price, payment method and cancellation terms are displayed. The customer may review and correct the information
• Submitting the booking constitutes a binding order. A distance contract is concluded when the booking confirmation is delivered to the customer's e-mail address.
• The confirmation includes at least the booking identifier, rental period, price, payment and cancellation terms, and the current Terms and Conditions on a durable medium or as a non-editable attachment
• SpišBike may reject an order, in particular if the bicycle is unavailable, the details are clearly incorrect, age or safety requirements are not met, or there are reasonable grounds to believe the rental item will not be used safely.

Article 5 - Price, payment and receipt

The final price is stated before submission of the booking and in the confirmation. SpišBike is not registered for VAT. The price includes all mandatory charges known at the time of booking. An additional charge may be applied only if it was clearly disclosed and the customer expressly agreed to it before submitting the booking.
Payment is made in cash or by payment card upon collection, unless the booking confirmation specifies otherwise. SpišBike issues the receipt required by law. No financial security deposit is required unless expressly specified in the booking confirmation or an individual agreement. The absence of a security deposit does not release the Renter from liability for damage.

Article 6 - Booking cancellation and change of rental period

The customer may cancel a booking by e-mail at info@spisbike.sk or by telephone at +421 949 233 894. Cancellation takes effect upon receipt by SpišBike.

Time of cancellationCancellation fee
More than 48 hours before the startNo cancellation fee
24 to 48 hours before the start50 % of the confirmed price
Less than 24 hours before the start100 % of the confirmed price
No-show without cancellation100 % of the confirmed price

The cancellation fee is a fixed compensation for reasonable costs and blocked capacity. If SpišBike demonstrably rents the same bicycle to another customer for the same period, the cancellation fee shall be reasonably reduced by the costs saved and the rental income received. A replacement rental period may be agreed individually free of charge.
Ordinary rain or a subjectively unfavourable forecast does not in itself establish a right to free cancellation. If SpišBike does not provide the service for safety reasons, a technical fault or bicycle unavailability, the customer may choose a replacement period or cancellation without charge; payments already received shall be refunded no later than 14 days.

Article 7 - Statutory right of withdrawal

The rental of an e-bike booked for an exactly agreed date or period is a service related to leisure activities provided at a specific time or within a specific period. Therefore, under Section 19(1)(l) of Act No. 108/2024 Coll., the consumer has no statutory 14-day right of withdrawal without giving a reason. This does not affect the right to cancel the booking under Article 6 or rights arising from liability for defects.

Article 8 - Bicycle collection and identity verification

The Renter shall arrive at the agreed time, prove their identity with a valid identity document, sign the rental agreement and inspect the condition of the bicycle and accessories. SpišBike records only data reasonably necessary to conclude and perform the contract. It does not make a copy of the identity document as a standard condition of rental. Any copy may be made only on the basis of separate, voluntary and revocable consent, without adverse consequences if consent is withheld, where identity can be reliably verified in another way.

SpišBike may refuse handover if the Renter refuses to prove their identity, refuses to sign the rental agreement or report, is under the influence of alcohol or other substances, or is unable to control the bicycle safely

Article 9 - Rules of use and safety

• The bicycle may be used only by Riders named in the rental agreement.
• During the ride, every Rider is contractually required to wear a properly fitted and fastened protective helmet; this does not affect cyclists' statutory obligations.
• Racing, jumps, stunt riding, bike parks, downhill trails, riding through water above motor level, pressure washing, chip tuning and other mechanical or software modifications are prohibited.
• Riding under the influence of alcohol, narcotic or psychotropic substances and use contrary to law, technical instructions or the operating rules are prohibited.
• When left unattended, the bicycle must be switched off and locked through the frame to a fixed point with the supplied lock. The battery key must not be left in the bicycle.

The Renter is responsible for compliance with road traffic rules and for assessing their own health and abilities. This provision does not exclude or limit SpišBike's statutory liability for the safety of the service provided or for defects in the bicycle.

Article 10 - Breakdown, accident and theft

The Renter shall stop riding immediately if continued use could endanger safety or increase damage, and shall contact SpišBike without delay. No repair may be carried out without prior consent, except for an action necessary to prevent imminent damage. In the event of theft or an accident involving a third party, the Renter shall call the Police Force of the Slovak Republic if required by the circumstances or by law and shall cooperate in documenting the incident

Article 11 - Tracking device

The bicycle may be equipped with a tracking device to protect high-value property. Its location is not normally monitored actively. Access is restricted to cases of failure to return the bicycle, reasonable suspicion of theft or embezzlement, or a serious safety incident. Data may be disclosed to the police, a court, an insurance company or legal representatives only to the extent necessary. Details are set out in Part 2 of this document and provided at personal collection.

Article 12 - Return and delay

The Renter shall return the bicycle and accessories at the agreed time and place, in a condition corresponding to proper use, taking normal wear and tear into account. The condition on return is recorded in the report. An unauthorised delay may be charged at EUR 15 for each hour or part thereof, but not more than an amount corresponding to the daily rental charge for each 24-hour period or part thereof. This does not affect the right to compensation for proven damage exceeding this charge if caused by a culpable breach of the Renter's obligations.

Article 13 - Liability for damage

The Renter is liable for actual and proven damage caused by a breach of contractual or statutory obligations. The Renter is not liable for normal wear and tear, a latent defect, a manufacturing defect or damage not caused by the Renter, unless otherwise provided by law. The price list of typical damage is an indicative basis for a preliminary calculation. Final compensation must not exceed reasonable and proven costs of repair, diagnostics, replacement parts and necessary installation, or the normal value of the destroyed or lost item after
taking its age and wear into account. SpišBike shall document the claim with a report, photographs, a service receipt or other credible evidence. In the event of theft or total loss, the degree of the Renter's fault, the bicycle's current value and any insurance payment shall be taken into account. SpišBike may not receive compensation for the same loss twice. Proven loss of profit may be claimed only to the extent permitted by law.

Article 14 - Service defects and complaints

A service defect may be reported by e-mail to info@spisbike.sk, by post to the registered office, in person at the pick-up location or by another demonstrable method. It is recommended to provide the booking number, a description of the defect, the time it was discovered and the remedy requested.
SpišBike shall issue written confirmation of the reported service defect without delay and state the period within which the defect will be remedied; this period may not exceed 30 days from the date the defect was reported. If SpišBike rejects liability for the defect, it shall provide written reasons. Depending on the nature of the defect, the consumer has rights under the Civil Code and Act No. 108/2024 Coll., in particular the right to have the defect remedied, to a reasonable discount or, in justified cases, to terminate the contract

Article 15 - Request for redress and alternative dispute resolution

If the consumer is dissatisfied with the handling of a complaint or believes that SpišBike has infringed their rights, the consumer may submit a request for redress to info@spisbike.sk. If SpišBike rejects the request or does not respond within 30 days after it was sent, the consumer may submit a proposal to initiate alternative dispute resolution. The competent residual ADR entity is the Slovak Trade Inspection, Central Inspectorate, Department of International Relations and Alternative Dispute Resolution for Consumer Disputes, Bajkalská 21/A, P.O. Box 29, 827 99 Bratislava 27, e-mail: ars@soi.sk or adr@soi.sk. Information and the form are available at www.soi.sk. The EU ODR platform ceased operation on 20 July 2025

Article 16 - Personal data protection

The processing of personal data is governed by INFORMATION ON PERSONAL DATA PROCESSING. Consent to marketing or optional cookies is not a condition of booking or rental

Article 17 - Final provisions

Legal relations are governed by the laws of the Slovak Republic, in particular the Civil Code, Act No. 108/2024 Coll. on Consumer Protection, Act No. 22/2004 Coll. on Electronic Commerce and Act No. 391/2015 Coll. on Alternative Resolution of Consumer Disputes. SpišBike may amend the Terms and Conditions only for future bookings. The version delivered to the customer in the confirmation applies to the particular booking. An invalid provision may not restrict the consumer's statutory rights.
